Terms of Service

1. Services
Holley Creative provides photography, drone cinematography, real estate photography, wedding photography, brand photography, and related visual media services. Specific deliverables, file formats, and timelines are defined in individual booking agreements.
2. Booking & Deposits
A non-refundable retainer/deposit is required to secure your session date. The remaining balance is due on or before the session date unless otherwise agreed in writing. Dates are not held without a signed agreement and received deposit.
3. Cancellation Policy
Cancellations made more than 14 days before a scheduled session may be rescheduled at no charge (subject to availability). Cancellations within 14 days of the session forfeit the deposit. Holley Creative reserves the right to cancel sessions due to unsafe weather or equipment failure, with a full rescheduling option offered.
4. Image Delivery
Edited images are delivered digitally within the timeframe specified in your booking agreement. Rush delivery may be available at additional cost. Raw/unedited files are not included unless explicitly agreed upon in writing.
5. Image Copyright & Licensing
All photographs are copyright © Matthew Holley and Marcus Holley, all rights reserved. Upon full payment, clients receive a personal use license to print and share images for non-commercial purposes. Commercial use (advertising, product sales, editorial licensing) requires a separate written commercial license agreement. Holley Creative retains the right to use images for portfolio, website, and promotional purposes unless a privacy addendum is signed.
6. Model & Property Releases
Clients and subjects photographed grant Holley Creative the right to use images for portfolio and promotional purposes by default. If you require a privacy clause restricting portfolio use, this must be requested in writing before the session and may incur an additional fee. Property owners are responsible for obtaining any required permits for photography on private property.
7. Drone Operations & FAA Compliance
Drone services are provided by a FAA Part 107 certified remote pilot. All drone operations comply with applicable FAA regulations, airspace restrictions, and local ordinances. Clients are responsible for obtaining any required property owner permissions for drone operations. Holley Creative reserves the right to decline drone operations in unsafe conditions or restricted airspace.
8. Limitation of Liability
In the event of equipment failure, illness, or circumstances beyond our control, Holley Creative's liability is limited to a refund of fees paid. We are not responsible for indirect or consequential damages including missed events or occasions.
9. Governing Law
These terms are governed by the laws of the State of Illinois. Disputes shall be resolved in Cook County, Illinois.
